TiVo files extensions of time to oppose Facebook’s “like” button

Facebook applied to register the word “LIKE” and the “like” button graphic in 2010.  Recently, the Facebook applications were approved by the USPTO and published in the public record.

TiVo Brands LLC has filed six (6) different extensions of time to Oppose the six Facebook applications for icon.

No one has filed to block the registration of the term “LIKE” in standard characters.

TiVo owns registrations for the following images which appear on its remote controls and menus:

Some possible considerations if a dispute arises between the parties:

– the Facebook icons also include the word “Like” and a rounded rectangular box

– the Facebook thumb appears to be the back of a right hand with a sleeve

– the TiVo icon appears to be the front of a left hand

– how similar are the services of the two parties? Does it matter that TiVo features a way to integrate Facebook? That TiVo has a Facebook page that users can “Like”? That

– how many other companies use “thumb” images or icons for related services?

What do you think will happen? Will TiVo oppose the applications? Will the parties enter into an agreement? Nothing?

Redskins and plaintiffs submit evidence to TTAB in trademark cancellation case

The dispute over the Washington Redskins trademarks has been ongoing for more than 15 years. It’s current form is a petition for cancellation before the Trademark Trial and Appeal Board with a set of plaintiffs that are different from the proceeding before the Board in the late 1990’s.  In that case, the TTAB had found for cancellation of the contested trademark registrations, finding them disparaging. But on appeal to a district court, the TTAB’s finding was overruled, in part because the court found that the plaintiffs had waiting too long to bring their claim.  The court then went up on appeal and back down the District Court and back up to the District of Columbia Circuit Court. The Supreme Court declined to hear the case.

Then a new case was filed at the TTAB with a new set of younger plaintiffs. The parties stipulated to many evidenciary procedures allowing for the use of much of the evidence from the prior proceeding. The TTAB case has now reached the “testimony” phase and the parties have submitted their evidence (the Plaintiffs may still submit rebuttal evidence). Almost all of the evidence of both the parties is from the prior proceeding. Both parties have submitted excerpts of depositions that took place more than 15 years ago, including the deposition of Jack Kent Cook , then the owner of the team, and many competing definitions and articles referencing the term ‘redskin.’ The Redskins did take the depositions of the new plaintiffs.

As a result of the documents and the depositions, the Board will have many thousands of pages to review in this matter. If an oral hearing is requested, it will certainly attract a lot of coverage.

Regardless of the decision of the TTAB – which could still be years away – the case of course could be appealed again.

During the week of April 23 – April29, 2012, the TTAB issued no precedential decisions. But it did issue several important findings on procedure and discovery. In discussing general discovery obligations, the Board noted “it is unhelpful to state in response to a document request that “[t]o the extent that such documents are in Applicant’s possession, Applicant will produce whatever documents he has within his control.”  This type of written response calls into question whether a party actually searched for documents and whether he has any responsive documents to produce.  For the sake of clarity,  increasing the usefulness of discovery and avoiding the necessity of contested discovery motions, the parties should simply indicate whether or not responsive documents exist and if they exist, the documents should be identified by Bates number or produced as kept in the ordinary course of business. During the week of April 2 – April 8, 2012, the TTAB did not issue any precedential decisions – however it issued many other decisions and rulings which cover important substantive and procedural issues.
